This course will explore the case law, statutory background, and facts relating to the death penalty in the United States and abroad. It will also examine various theories of sentencing for murder, including deterrence and incapacitation theory, as well as mitigation of punishment.
The course is designed to focus on contemporary issues with respect to capital punishment. The role that common law has played in shaping our understanding of the death penalty in the United States will be discussed. The course is not intended to
