Generally a PSC must be a calendar year taxpayer . Mimi’s Consulting Services wants to use a year end other than the calendar year end . You have explained to Mimi, the sole shareholder of Mimi’s Consulting Services , that the only exception to this rule is when the taxpayer , in this case Mimi’s Consulting Services , can demonstrate a business purpose for a fiscal year end (not a calendar year end). Mimi’s Consulting Services has asked you to prepare a tax memo explaining the business purpose exception. You should include examples of when this exception is satisfied and examples that will not satisfy the exception . When researching you may want to consider the following (and please note this is not an exhaustive list just a guide to help you get started): IRC $441 (i) Regs. Sec. $1.441-3 Your responsibility : Prepare a tax research memo addressing the question that has been raised. Do yourself a favor and look at the grading rubric before you submit. This memo should be whatever length you feel is appropriate to resolve the issues. We do NOT use a bibliography or list of references in a tax research memo. You will see that citations are within the text of the document in the example . Once a court case has been cited in full, it can be referred to using simply the name in italics .
